Guidance for Every Level of Leadership

  • When surveyors cite deficiencies, the stakes are high. For example, two D-level abuse deficiencies can trigger the Red Hand Alert Icon on the CMS Care Compare website, causing an ACO to refuse to make referrals.

Likewise, an “immediate jeopardy” citation can lead to a high civil money penalty (CMP), a denial of payment for new admissions (DPNA), lower Five-Star Quality ratings and even termination from Medicare. Alan & Associates assist medical directors, administrators, and DONs in achieving and maintaining regulatory compliance while ensuring quality care for SNF, hospice and home health care residents/patients.

  • When CMS imposes a CMP, a DPNA, or termination from Medicare, SNFs  rely on Alan’s unique perspective as both a former HHS attorney and healthcare provider as well as his successful representation of SNFs, hospices, and home health agencies. Additionally, Drs. Karl Steinberg and Dan Haimowitz provide the expert medical evaluation, analysis, and recommendations necessary for an optimal outcome.

  • CMS remedies can jeopardize your business and your reputation , Alan C. Horowitz & Associates, LLC provides the legal strategy and advocacy you need to safeguard your facility and your reputation.

Testimonials

  • "Alan has been a tireless advocate for our Center over the past 8 years as we have navigated a legal challenge to a significant civil money penalty imposed by CMS after a survey. He is thorough, persistent and knows the law backwards and forwards. While the process of fighting a CMP can be frustrating, Alan is the right legal mind for the challenge. We couldn’t be in better hands.”

    - Celeste Emrick, LNHA, PCHA, MPM & BS,

Former Regional Manager, Division of Nursing Care Facilities, Pennsylvania Department of Health, former executive director and nursing home administrator.

  • “I have worked with Alan C. Horowitz for more than 30 years, first as counsel to CMS and later as outside counsel to SavaSeniorCare. As counsel to CMS, I found Alan to be reasonable and fair. While he represented the government, he was always willing to listen and to try to work with his client to see a way to resolution. You rarely see that with agency lawyers. As outside counsel to my company, I always respected Alan’s wisdom and the way he would work to try to find the best solution for the company.

Alan is a smart, ethical, problem solver who listens to his client’s needs and works to meet those needs. He always kept our residents in mind, which to me was the most important part of our respective roles.

I also know Alan as a friend and comrade. We have shared a lot of times together, good and bad. I have, and will always, think of him fondly. Alan is a good choice for anyone looking for an ethical, solution driven legal partner.”

    - Nan Impink

    General Counsel United Digestive

  • “I’ve worked with Alan for well over a decade and I haven’t found a more intelligent or creative attorney.  His experience inside the government at the HHS Office of the General Counsel (OGC) gives him such valuable insight not only into the way they work but also the way they think.  Alan is results oriented and finds solutions even when you may feel like David going against Goliath and he does not believe in Pyrrhic victories.  He’s first on my speed dial in any confrontation with CMS and he should be yours!”

    - Mark A. Yost, Esq.

General Counsel and Chief Compliance Officer, Proud Moments ABA, former CEO and General Counsel, NMS, a Maryland-based chain of skilled nursing facilities

  • “It was my professional pleasure to have worked with Alan during his tenure as Assistant Regional Counsel with the US Dept. of Health and Human Services' Office of the Genral Counsel. As a skilled registered nurse and respiratory therapist, his insight into noncompliance related to complex clinical cases was invaluable. Our clinical (as well as regulatory) discussions were extremely beneficial in ‘getting the whole picture’ for the cases involved.  His passion for ensuring patient safety and quality care has been a hallmark of his practice. Additionally, he has the innate ability to communicate effectively to the general public or non-legal professionals whether in published articles or in-person presentations. His responsiveness to questions related to any health care issues is appreciated as a credible resource.”
